Labour Standards in Alberta (AB)

The Alberta Employment Standards Branch has laid out Alberta's labour standards in two documents: Employment Standards Code and the Employment Standards Regulation. These documents cover everything from minimum wage to payroll deductions to statutory holidays to regulations that apply to temporary foreign workers. It also covers special rules that apply to industries like high tech, agriculture and logging.

Alberta's Labour Standards - Highlights

  • Minimum Wage: Alberta's minimum wage is $8.40/hour. This wage applies whether you are paid hourly, on a salary or paid by commission.
  • Maximum working hours: In Alberta, employees cannot work more than 12 consecutive hours unless there is an emergency or the employer has a special permit from the government.
  • Meal Breaks: Your employer cannot make you work longer than 5 hours without a 30-minute unpaid meal break. If you work for less than 5 hours, your employer is not required to give you a meal break.
  • Rest Between Shifts: Employees must get at least 8 hours of rest between shifts.
  • Overtime: After 8 hours of work in a day, employees receive one-and-a-half times their regular wage. On a weekly basis, employees receive time-and-a-half for every hour they work over 44 hours.
  • Statutory Holidays: Employees in Alberta receive nine statutory holidays per year.
  • Vacation Pay: You are eligible for 2 weeks of paid vacation after working for one year. After five years of employment, you get 3 weeks of paid vacation.
