Pre-approval to Hire Temporary Foreign Workers

Some employers find themselves in a position where they need to hire foreign workers for an occupation that requires prolonged and extensive recruitment efforts, usually due to the number of workers required or the complexity or special qualifications required by the job. If you're in this position, you could qualify for "approval in principle" from Service Canada prior to recruiting these workers. To obtain pre-approval, you must go through the following steps.

How to Get Pre-Approval to Hire Temporary Foreign Workers in Canada

Begin by applying for a Labour Market Opinion, but leave the foreign worker information blank and indicate that this application form represents your request for pre-approval. If you have any questions about this, contact your nearest Service Canada Centre. Once Service Canada has made a decision regarding your request for pre-approval, they will notify you of their verdict.

If Your Request for Pre-Approval is Granted

If Service Canada grants your pre-approval request, you can begin recruiting foreign workers immediately. Positive Labour Market Opinions (LMO) will be issued to each successfully recruited candidate, subject to you meeting all appropriate conditions. Once you receive a positive LMO , send a copy of your confirmation letter to each foreign worker you have recruited. Then they can proceed to apply for a work permit as well as a temporary resident visa, if necessary.

If Your Request for Pre-Approval is Denied

If Service Canada does not grant your pre-approval request, do not proceed to recruit foreign workers. You may appeal Service Canada decisions by submitting new information that may cause them to view your application for pre-approval in a new light.
